What happened: on February 6, 2026, Judge Jeannette Vargas of the Southern District of New York denied Compass's request to block Zillow's Listing Access Standards, finding Compass hadn't shown it was likely to win (Real Estate News). On March 18, 2026, Compass dropped its lawsuit without prejudice after Zillow introduced Preview, a product highlighting pre-market listings (Real Estate News). A separate Zillow case against Chicago's MRED MLS is still pending (HousingWire, Jul 31, 2026).
Why it matters today: how and when you market a listing decides whether it appears on Zillow, and, through Zillow's ChatGPT app, in AI search too (our explainer).
The standards in one paragraph
Announced in April 2025, with enforcement from late June 2025, Zillow's standards bar a home from Zillow if it's publicly marketed but not made available through IDX or VOW feeds within one business day (HousingWire; Real Estate News). The target is "private" listings marketed to the public, for example on a brokerage's own site, without being shared broadly.

What changed with Preview
Compass described Zillow's Preview as a "reversal." Zillow said it would no longer bar sellers and agents from publicly marketing a listing on Redfin or Compass-family sites before marketing it on Zillow (The MortgagePoint). But Zillow insists the standards remain in effect, and that private listing networks conflict with them (Real Estate News).
In practice: pre-marketing is more workable than before, but publicly marketing a listing while keeping it off broad feeds still risks a Zillow ban.
The Chicago case to watch
Zillow sued MRED and Compass, arguing they moved "in lockstep" to block its standards; MRED says Zillow's harm is "self-inflicted" and that its own display rules require objective criteria. A preliminary-injunction ruling is pending (HousingWire). The outcome could affect how MLSs and Zillow coexist.
What to tell sellers
Sellers increasingly ask about "off-market" or "private" launches. A plain-English explanation keeps you on the right side of your MLS, Zillow and your fiduciary duty:
"We can test the market quietly first, or launch everywhere at once. A quiet launch can protect your privacy and help us test pricing, but once we market publicly, the listing needs to go into the MLS within a day. If it doesn't, Zillow won't show it at all, and that also means it won't appear when buyers search through ChatGPT. Most buyers start online, so for most sellers maximum exposure gets the best price. Which approach fits your goals?"
Then put the seller's decision in writing. If a dispute arises later about exposure or price, that record matters.
Your listing-marketing playbook
- Talk to sellers early about exposure. Explain the trade-off between private or pre-marketing and maximum portal reach, and document their choice.
- If you'll market publicly, get it into the MLS within one business day.
- Check your brokerage's policy on office exclusives and pre-marketing.
- Use AI tools for the launch, like descriptions, staging and social posts, but keep facts and fair housing in check (AI listing copy rules; staging disclosure).
- Watch the MRED ruling if you're in Chicagoland.
FAQ
Can I still do "coming soon" marketing?
Yes, within your MLS's rules. The risk is public marketing that isn't shared through IDX or VOW feeds within a day.
Did Compass win?
No. It lost its injunction bid and voluntarily dismissed the case without prejudice, so it could refile.
Does this affect my AI-generated marketing?
Indirectly. A listing banned from Zillow also won't appear in Zillow's ChatGPT app.
