Can Financial Advisors Use AI Notetakers? SEC & FINRA Rules (2026)

Short answer: yes, but AI doesn't change your obligations. FINRA says its rules are technology neutral and apply to generative AI like any other tool. On the SEC side, an AI-drafted email recommending a trade is still a written communication about advice that you must keep for five years. The off-channel texting crackdown shows what happens when firms lose track of where business communications live.
Not legal or compliance advice. Rules differ for RIAs, broker-dealers and dual registrants. Your CCO and written policies decide what's allowed at your firm.
1. FINRA Regulatory Notice 24-09
FINRA's June 27, 2024 notice reminds member firms that existing rules apply to generative AI and large language models, whether a firm builds its own tool or uses a vendor's, including AI features embedded in products you already use (FINRA Notice 24-09). Key points:
- Evaluate before deploying: check that you can still meet your obligations using the tool.
- Supervision (Rule 3110): if AI is part of supervision, such as reviewing correspondence, your policies should cover governance, model risk, data privacy and accuracy.
- Communications (Rule 2210): content standards apply whether a person or an AI wrote the communication.
2. SEC Rule 204-2: what an adviser must keep
Registered investment advisers must keep written communications sent and received relating to any recommendation or advice, the receipt or delivery of funds or securities, orders, and performance. Records must be kept at least five years, with the first two in an appropriate office, and be easily accessible (17 CFR §275.204-2). Broker-dealers have broader requirements under Exchange Act Rule 17a-4.
What that means for AI tools:
- Follow-up emails drafted by AI and sent to clients are communications. Archive them like any other email.
- AI meeting summaries that document recommendations are likely records. Many firms treat them that way by policy.
- Recordings and transcripts may become records too, which is one reason some advisors prefer tools that don't record. Zocks, for example, says it never records conversations (Zocks).
3. Why regulators care: the off-channel crackdown
On August 14, 2024, the SEC announced settlements totaling about $393 million with 26 investment advisers and broker-dealers over business communications kept on unapproved channels such as personal texting apps. That followed a sweep that has reached stand-alone RIAs since April 2024 (Greenberg Traurig). The lesson for AI: a notetaker or assistant that creates or sends client communications outside your archived systems is the same problem in a new form.
A CCO-friendly checklist for any AI notetaker
- Approval first: add the tool to your approved-technology list and written policies.
- Archiving: confirm where notes, transcripts and AI-drafted emails are stored, and that they reach your archive (or the CRM that feeds it) automatically.
- Retention settings: match the vendor's retention to your books-and-records schedule, not the vendor's default. Zocks offers custom retention from its Professional tier, and Jump's Enterprise plan adds a compliance dashboard and custom disclosures (Jump).
- Supervision: decide who reviews AI-drafted client emails before they're sent, and log it.
- Client consent and disclosure: tell clients when meetings are transcribed, and check state recording-consent laws if anything is recorded.
- Vendor due diligence: security reports, data-training terms, breach notification, and Regulation S-P obligations for customer information.
- Accuracy review: the advisor reviews every summary before it becomes the record.

FAQ
Are AI meeting notes official books and records?
If they document advice or recommendations, treat them as records. Many firms choose to retain all AI meeting notes to be safe.
Can AI send client emails automatically?
Technically yes. In practice, most firms require advisor review before sending, because the content standards for communications still apply.
Does FINRA ban any AI tools?
No. Notice 24-09 is technology neutral: tools are allowed as long as you can still meet your obligations.
